Webz.io Ltd. (“ Webz.io ” or “ we “) welcomes you (the “ User “, ” Company ” or “ you “) to Lunar Cyber, a free data breach monitoring service accessible at: https://lunarcyber.com. Lunar Cyber provides companies with monitoring and alerting services regarding potential data breaches and information stealer malware affecting their domain, including access to breach data upon domain ownership verification (collectively – the “ Services “).
If you choose to use, access, or connect to Lunar Cyber and/or the Services (as defined below), you will be acknowledging that you have read and understood the following terms of use, including the terms of our Privacy Policy referenced in Section 8 below (collectively, the “Terms“), and you will be agreeing to be bound by them and to comply with all applicable laws and regulations regarding your use of the Services.
These Terms constitute a binding and enforceable legal contract between Webz.io and you. If you do not agree to these Terms, please do not enter into, connect to, access, or use Lunar Cyber and/or the Services.
In these Terms, the following terms shall have the meaning defined hereunder:
“Breach Data” means information regarding data breaches and stealer malware information affecting Company’s domain(s), which includes: (i) aggregated summary information accessible without Domain Verification (excluding personally identifiable information), and (ii) detailed breach information including breach metadata, affected Credentials, and personally identifiable information (PII) accessible only after successful Domain Verification, as collected and processed through the Webz.io System.
“Credentials” means any user accounts, passwords and other authentication credentials associated with use of the Service by Company or its employees.
“Domain Verification” means any method or process, as determined by the Company in its sole discretion, by which a Company may confirm ownership or control of a domain, including but not limited to email verification, DNS record configuration, file upload, API token validation, or other technological or administrative verification methods, whether now existing or hereafter developed.
“Intellectual Property Rights” means: (i) patents and patent applications; (ii) trade secrets and confidential information; (iii) copyrights; (iv) trademarks, service marks, and logos; (v) moral rights where recognized; and (vi) all other intellectual property and proprietary rights throughout the world.
“Webz.io System” means Webz.io web crawlers that crawl various third-party content platforms, extract data from them; clean, organize, and process such data.
Lunar Cyber provides you with free access to breach monitoring services for your domain. Upon visiting the Lunar Cyber website and entering your domain, you will receive aggregated summary information about potential data breaches and information stealer malware affecting your domain, excluding personally identifiable information (PII). To access detailed Breach Data including PII and to activate ongoing monitoring services, you must complete Domain Verification. Subject to these Terms, Webz.io grants you a limited, non-exclusive, non-sublicensable, non-transferable license to access and use the Services solely for monitoring and investigating data breaches and information stealer malware affecting your verified domain(s) and for internal cybersecurity purposes within your organization (collectively, the ” Permitted Use “). You may not resell, sublicense, or redistribute the Services or Breach Data provided therethrough to any third party.
In order for us to be able to continue providing and improving our Services, there are certain conducts which are strictly prohibited. Without the express written permission of Webz.io, you agree that you will not, whether by yourself or anyone on your behalf:
a. interfere with or violate any other Services or user’s right to privacy or other rights, or harvest or collect personally identifiable information about visitors or users of the Services, and/or the Breach Data provided therethrough without their express and informed consent;
b. use the Breach Data, and any of the Services for any illegal, unauthorized or other improper purposes;
c. otherwise infringe or violate any of these Terms.
The Breach Data provided to you through the Services may include data and information from third-party sources that is not under the control of Webz.io, and Webz.io is not responsible for any content contained therein. Since the Breach Data is generated automatically by the Webz.io System, Webz.io does not review the Breach Data at any stage and makes no warranties or representations with respect to the Breach Data, including with respect to its legality, non-infringement, offensiveness, ownership and content. Webz.io is not responsible for the availability or content of Breach Data. Your use of and reliance upon Breach Data is at your sole risk. Webz.io reserves the right to remove any data from the Breach Data at any time.
The Services may include personal data collected by Webz.io from public sources in accordance with its privacy notice at: http://webz.io/information-notice-regarding-data-collected-from-public-sources. Each party is an independent controller and shall comply with applicable data protection laws. For EEA personal data transferred to non-adequate countries, transfers shall be governed by the Standard Contractual Clauses in Commission Decision 2021/914/EU (MODULE 1: Transfer Controller to Controller), which are incorporated herein by reference.
Webz.io offers additional paid services beyond the free Services, including enterprise-grade dark web and cyber threat intelligence solutions. If you choose to subscribe to or use any of Webz.io’s paid services, such use shall be governed by the applicable terms of service for those paid services, including without limitation the Webz.io Dark Web Terms of Service available at: https://webz.io/dw-tos/. The terms governing paid services are separate from and independent of these Terms, which apply solely to the free Lunar Cyber service described herein.
Each party agrees to maintain in strict confidence all non-public information disclosed by the other party (“Confidential Information”) and to use such information only as necessary to perform under these Terms. For clarity, any information automatically generated, processed, or derived by the Webz.io System, including, without limitation, any Breach Data, system outputs, analytics, algorithms, and/or methodologies, shall not be deemed Confidential Information of User, regardless of whether such information relates to User’s domain. User’s Confidential Information is limited to non-public business information that User affirmatively provides to Webz.io in writing and clearly marks as confidential. The confidentiality obligations shall not apply to information that: (i) is or becomes publicly available through no fault of the receiving party; (ii) was already known without restriction; (iii) is independently developed; or (iv) is lawfully received from a third party without confidentiality restrictions.
The Services and any software used in connection therewith (“Software”), any inventions, ideas, concepts, information, materials, methods, processes, data and databases, compilations, programs, software, know-how, discoveries, developments, designs, artwork, formulae, algorithms, including improvements and derivatives thereof, other copyrightable works, and techniques and all Intellectual Property Rights (as defined below) contained therein or related thereto are and will at all times remain the sole and exclusive property of Webz.io and/or its licensors and are protected by applicable intellectual property and other laws and treaties. You will not, by use of the Services and/or by accessing the Breach Data provided therethrough, acquire any right, title or interest in any rights of Webz.io under these Terms or otherwise.
These terms do not convey to you an interest in or to the Services and/or the Breach Data provided therethrough, but only a limited revocable right to use them in accordance with the terms of these Terms and solely for the Permitted Use. Nothing in these Terms constitutes a waiver of Webz.io’s intellectual property rights under any law.
Webz.io’s current Privacy Policy is available at http://webz.io/privacy and is incorporated herein by reference. We may change our Privacy Policy from time to time and our changes are effective as set forth in the Privacy Policy.
THE LUNAR CYBER SERVICE, INCLUDING THE PLATFORM, BREACH MONITORING ALERTS, AND ANY CONTENT AND INFORMATION RELATED THERETO, ARE PROVIDED ON AN “AS IS” BASIS FOR INFORMATIONAL PURPOSES ONLY. WEBZ.IO MAKES NO WARRANTIES REGARDING THE COMPLETENESS, ACCURACY, TIMELINESS, OR RELIABILITY OF THE BREACH DATA OR MONITORING ALERTS. WEBZ.IO DOES NOT WARRANT THAT THE LUNAR CYBER SERVICE SHALL BE ERROR-FREE OR THAT IT SHALL OPERATE UNINTERRUPTED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBZ.IO DISCLAIMS ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, ACCURACY, RELIABILITY AND NON-INFRINGEMENT. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THESE TERMS.
The Webz.io system crawls and monitors sources including dark web sources and breach databases that are in its index from time to time on a cyclical basis. Webz.io will use commercially reasonable efforts to maintain regular crawl and monitoring cycles, though specific timing may vary based on source availability and technical considerations. Webz.io does not guarantee crawling or monitoring of any specific source(s) or a certain minimum number or percentage of sources, but will provide reasonable notice of material changes to crawl or monitoring coverage that may affect Customer’s use of the Services.
When you access or use the Service, Webz.io may use industry-wide technologies such as “cookies” (or similar technologies), which store certain information on your computer (“Local Storage”) and which will allow us to enable automatic activation of certain features, and make your Service experience much more convenient and effortless. By continuing to use the Service, you consent to our use of cookies as described herein. The cookies used by the Service are created per session, do not include any personal information about you other than your session key, and are removed as your session ends. Webz.io will handle all cookie data in accordance with applicable data protection laws, including the Protection of Privacy Law, 5741-1981, and its data protection policies. You may prohibit Local Storage through your browser settings. Most browsers will allow you to erase cookies from your computer’s hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. However, if you block or erase cookies your online experience may be limited.
Notwithstanding anything herein to the contrary, and to the maximum extent permitted by Israeli law, Webz.io’s, including, without limitation, its officers, directors, shareholders, employees, sub-contractors, agents and affiliates, sole and cumulative liability to you or to any third party for any loss, cost or damage resulting from any claims, demands or actions arising out of, or relating to, these Terms and/or your use of the Services shall not exceed NIS 100 (one hundred New Israeli Shekels) in the aggregate.
To the maximum extent permitted by Israeli law, Webz.io shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to, damages for loss of profits, revenue, goodwill, data, or other economic advantage (even if Webz.io has been advised of the possibility of such damages), however caused and regardless of the theory of liability, whether in contract (including fundamental breach), tort (including negligence) or otherwise, arising out of or related to the use of or the inability to use or the reliance upon the breach monitoring information displayed, contained, and/or delivered by the the Services for any reason.
You agree to defend, indemnify and hold harmless Webz.io, including its officers, directors, shareholders, employees, sub-contractors, agents and affiliates, from and against any and all third-party claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to reasonable attorney’s fees) arising from: (i) your unauthorized use of the Lunar Cyber Service in violation of these Terms; (ii) your violation of applicable laws or regulations in connection with your use of the Service; (iii) your breach of any third party intellectual property rights or other proprietary rights through your use of the Service; (iv) your misuse of Breach Data or personally identifiable information (PII) obtained through the Service; or (v) your gross negligence or willful misconduct.
Webz.io may change the Terms from time to time, and such changes will be effective as of the stated “Last Revised” date. For material changes to fees, liability limitations, indemnification obligations, or data protection terms, Webz.io will provide at least thirty (30) days’ advance notice by email or through the Services. If you do not agree to any material changes, your sole remedy is to discontinue use of the Services prior to the effective date of such changes. Your continued use of the Services and/or the Breach Data provided therethrough after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes.
Webz.io reserves the right to, at any time, at its sole discretion and without prior notice: (i) add additional Services, whether or not subject to a fee; (ii) change, alter or otherwise modify the Services offered; (iii) discontinue all or any of the Services; and/or (iv) make certain Services previously offered free of charge subject to payment of a fee, and vice versa, for all or some users.
At any time, Webz.io may block your access to the Services, and/or terminate these Terms, for any reason, at its sole discretion. Additionally, Webz.io may at any time, at its sole discretion, cease the operation of the Services, and/or the Breach Data provided therethrough or any part thereof, temporarily or permanently, without giving any prior notice. You agree and acknowledge that Webz.io does not assume any responsibility with respect to or in connection with the termination of the Services and/or the Breach Data provided therethrough.
Any claim relating to the Services and/or Breach Data provided therethrough thereof will be governed by and interpreted in accordance with the laws of the State of Israel without reference to its conflict-of-laws principles. Any dispute arising out of or related to your use of the Services and/or the Breach Data provided therethrough, will be brought in, and you hereby consent to the exclusive jurisdiction and venue in, the competent courts in Tel Aviv, Israel. If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provision. You may not assign, sublicense or otherwise transfer any or all of your rights or obligations under these Terms without Webz.io’s prior express written consent. No waiver by either party of any breach or default hereunder will be deemed to be a waiver of any preceding or subsequent breach or default. Any heading, caption or section title contained herein is inserted only as a matter of convenience, and in no way defines or explains any section or provision hereof. These Terms are the entire terms and conditions between you and Webz.io relating to the subject matter herein and supersede any and all prior or contemporaneous written or oral agreements or understandings between you and Webz.io. Lunar Cyber website may provide notices of changes to these Terms or other matters, by displaying such notices or by providing links to such notices. Without limitation, you agree that a printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
